Terms of Service

These Terms of Service ("Terms") govern your access to and use of ViralHunt (the "Service"), operated by ViralHunt.io ("ViralHunt", "we", "us"). By creating an account, starting a trial, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

ViralHunt aggregates and surfaces publicly available trending and viral content from third-party networks (including TikTok, Instagram, Facebook, Pinterest, Reddit, X, Quora, Tumblr and RSS feeds) and provides tools to track engagement, discover trends, and organize content curation with your team (including an Editorial Board, team chat, and an AI Content Studio). The Service is provided on a subscription basis and may change or evolve over time.

2. Accounts & eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials and API tokens secure, and for all activity that occurs under your account. Notify us promptly at support@viralhunt.io of any unauthorized use. If you create sub-users or add an AI agent to your organization, you are responsible for their use of the Service under your account.

3. Subscriptions, trials & billing

• Free trial. New subscriptions may include a 7-day free trial. A valid payment method is required to start the trial. You will not be charged during the trial, and you can cancel any time before it ends to avoid being billed.
• Billing. If you do not cancel before the trial ends, your subscription begins and your payment method is charged the then-current plan price (billed monthly or annually, as selected). Subscriptions renew automatically until cancelled.
• Payments are processed by third-party payment providers (e.g., Stripe and/or PayPal). We do not store your full card details.
• Cancellation. You may cancel at any time from your account; access continues until the end of the current billing period.
• Refunds. Except where required by law, payments are non-refundable. Taxes may apply based on your location.
• Price changes. We may change prices; we will give notice before a change applies to your next renewal.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms or the terms of any third-party platform;
• Resell, sublicense, or provide the Service to third parties except as expressly permitted;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Interfere with or disrupt the Service, or circumvent rate limits or security measures;
• Use the Service to harass, defame, infringe, or violate the rights or privacy of others.

5. Third-party platforms & content

ViralHunt is not affiliated with, endorsed by, or sponsored by TikTok, Meta (Facebook, Instagram), Pinterest, Reddit, X, Quora, Tumblr, or any other platform. All platform names, logos, and trademarks are the property of their respective owners and are used for identification only. The Service surfaces content and metrics from these platforms as available; that content belongs to its respective owners and is subject to those platforms' own terms. We do not guarantee the accuracy, availability, or completeness of third-party data, and platform behavior or access may change at any time outside our control. You are responsible for complying with the applicable platform's terms when you use data surfaced through the Service.

6. Your content

You retain ownership of the content, notes, cards, and materials you create or upload in the Service ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and provide the Service to you and your organization. You are responsible for Your Content and for ensuring you have the rights necessary to use it, including any content generated with the AI Content Studio before you publish it elsewhere.

7. API & automated access

The Service offers an API and AI-agent access secured by personal tokens. You must keep tokens confidential, use them only within your own organization, and stay within published rate limits. We may suspend or revoke tokens that are abused or that threaten the stability or security of the Service.

8. Intellectual property

The Service, including its software, design, and content (excluding Your Content and third-party content), is owned by ViralHunt and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. No other rights are granted.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that trends, metrics, or predictions surfaced by the Service are accurate or will produce any particular result.

10. Limitation of liability

To the maximum extent permitted by law, ViralHunt and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.

11. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or if required to protect the Service or other users. Upon termination, your right to use the Service ends; provisions that by their nature should survive (e.g., payment, disclaimers, liability, governing law) will survive.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, unless applicable law requires otherwise.
